Partners in a business have certain duties to each other called “fiduciary duties.” Married couples have similar fiduciary duties to each other. One of these duties includes the right to not take any unfair advantage of the other party. For example, if one Party takes community funds during marriage and uses them without the other person’s knowledge, they may be deemed to have breached their fiduciary duties to the other spouse.
